California Privacy Rights
Notice for Employees and Contractors

Under the California Privacy Rights Act (“CPRA”), Smile Farms, Inc. (“Smile Farms” or “We”) is required to provide California residents who are our employees and contractors with a notice about “personal information” We collect about you. This notice also applies to any personal information that We may collect about emergency contacts. For employees, this notice also applies to personal information We may collect to administer employment benefits to other individuals.
This notice applies only to “personal information” that is subject to the CPRA. For example, this notice does not apply to personal information that is exempted from the CPRA, such as personal information covered by other privacy laws like the Health Insurance Portability and Accountability Act, the Confidentiality of Medical Information Act, or the Fair Credit Reporting Act.
Categories of Personal Information We Collect. We may collect some or all of the following categories of personal information about you:
- Personal and online identifiers (such as first and last name, Social Security number, email address, login credentials, or unique online identifiers)
- Record-keeping information (such as insurance policy number, bank account number, and financial information)
- Characteristics of protected classifications under California or federal law (such as race, gender, sex, or marital status)
- Commercial or transactions information (such as expense records)
- Internet or other electronic network activity information (such as browsing history, search history, and interactions with websites and emails)
- Geolocation information (such as your physical address)
• Audiovisual information (such as photos on ID badges and recordings collected through online conferencing tools) - Professional or employment-related information (such as records relating to your employment with Smile Farms)
• Education information (such as information included on your resume) - Sensitive personal information (such as race, ethnicity, passport information for eligibility purposes, or health-related information for disability accommodations or benefits, in addition to other data types described above)
- Other information about you that is linked to the personal information above
Categories of Sources. We may collect personal information from the following categories of sources:
- Directly from you. We may collect personal information directly from you during your relationship with Smile Farms.
- Indirectly from you. We may collect personal information about you indirectly, such as by monitoring your activities in accordance with our policies and procedures.
- Smile Farms personnel. When you are an emergency contact or beneficiary of a Smile Farms employee or contractor, We may collect personal information about you from that employee or contractor. When you are a Smile Farms employee or contractor, We may also collect personal information about you from other Smile Farms employees or contractors.
- Our service providers, such as those that administer payroll and employee benefits.
Categories of Third Parties to Which We Disclose Personal Information. We do not sell the personal information We collect about you or share this information for online targeted advertising purposes. However, We may disclose the personal information We collect to the following categories of recipients:
- Service providers. We disclose the personal information We collect to our service providers, such as those that maintain our records, administer employee benefits or payroll, or assist with human resources functions.
- Government entities. We may provide personal information to government entities, such as for reporting purposes.
- Other persons pursuant to legal process, such as a court order or subpoena, or with your consent.
How We Use Your Personal Information. We may use and disclose the personal information We collect about you for our commercial and business purposes. These commercial and business purposes may include, without limitation:
- Using your information in connection with your roles and responsibilities. This includes, for example:
- Providing you with services and tools to use in connection with your relationship with Smile Farms, such as email service and information technologies;
- Responding to your requests;
- Maintaining compliance with our policies and procedures;
- Paying you and, for employees, administering your employment benefits; including those provided to other individuals like family members; and
- Responding to emergencies or safety concerns, such as by maintaining and using your emergency contact information.
- Our commercial purposes, including fulfillment services, facilitating transactions, and providing you with special offers available to employees.
- Other business purposes as identified in the CPRA, which include:
- Auditing related to our interactions with you;
- Legal compliance;
- Detecting and protecting against security incidents, fraud, and illegal activity;
- Debugging;
- Performing services (for us or our service provider) such as account servicing, processing orders and payments, and analytics;
- Internal research for technological improvement;
- Internal operations;
- Activities to maintain and improve our business; and
- Other one-time uses.
How Long We Retain Personal Information. The personal information We collect about you may be stored by Smile Farms or by our service providers on our behalf. We retain personal information that We collect for as long as We need to use it in connection with our business and in accordance with applicable laws.
Your Rights. As a California resident, you have certain rights under the CPRA related to personal information Smile Farms collects about you. You may be able to exercise the following rights, subject to certain exceptions and limitations:
- The right to know the categories and specific pieces of personal information We collect, use, and disclose about you, the categories of sources from which We collected personal information about you, our purposes for collecting or disclosing personal information, and the categories of third parties to which We have disclosed personal information.
- The right to request that we delete the personal information We have collected from you.
- The right to correct inaccurate personal information We maintain about you.
- The right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CPRA.
While the CPRA provides an opt-out opportunity related to sensitive personal information, Smile Farms uses and discloses sensitive personal information, as defined under the CPRA, only for purposes permitted by the CPRA that do not require an opt-out opportunity.

Verification Process and Required Information. In some cases, We may need to request additional information from you to verify your identity or understand the scope of your request. Generally, We verify your identity by matching the information provided in your request with the information We maintain in our records.
Authorized Agent. You may designate an authorized agent to submit a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide the agent with signed permission to do so and provide proof of your identity, or the agent must have a valid power of attorney. An authorized agent can make a request on your behalf through one of the submission methods noted above. In order for us to process the request, the authorized agent will be required to provide evidence of signed permission and your e-mail address to verify your identity, or proof of valid power of attorney.
